PREAMBLE
- These general conditions of sale are agreed between “YES, Ideias Espaço e Soluções Lda”, with registered office at Av. Emília 341 R/C Esq, 2765-480 Estoril, tax identification number 507836740 and contact number +351 219243560, hereinafter referred to as “Yes”, and the individuals wishing to make purchases through the website www.YesLda.pt, hereinafter referred to as the “User”.
- The parties agree that purchases made through the website www.YesLda.pt shall be exclusively governed by this contract, to the exclusion of any conditions previously available on the website.
ARTICLE 1 – PURPOSE
- The purpose of these general conditions of sale is to provide and define all the necessary information for the User regarding the ordering, sale, payment and delivery procedures for purchases made on the website www.YesLda.pt.
- These conditions regulate all the steps required to place an order and ensure the follow-up of this order between the Contracting Parties.
ARTICLE 2 – ORDER
- The User places their order by completing the purchase process available on the website www.YesLda.pt, adding the product(s) or service(s) they wish to order to the shopping basket.
- To submit their order, the User must:
- a) Register on the website www.YesLda.pt by providing the requested information.
- b) Log in (using the email and password combination chosen by the User upon registration).
- c) Complete the information and select the options provided throughout the checkout process (delivery and billing address, shipping method, payment method, as well as the Tax Identification Number and name to appear on the invoice for tax purposes).
- The User’s final confirmation of the order constitutes full and complete acceptance of the prices and description of the products available for sale, as well as of these General Conditions of Sale, which shall be the only ones applicable to the contract thus concluded.
- Yes shall honour online orders only up to the limit of available stock. In the event a product is unavailable, Yes undertakes to inform the User as soon as possible.
- The information included on the invoice is the sole responsibility of the User. Once issued, the invoice cannot be altered.
- Order requests are valid for 120 (one hundred and twenty) days, except when the order is placed under a promotional campaign that specifies a different deadline. Prices, discounts, promotions and offers cannot be guaranteed beyond this period. If payment is not received by our services within the given timeframe, the order cannot be validated. Any amount received after this date shall be refunded or used towards a new order.
ARTICLE 3 – PAYMENT
- On the website www.YesLda.pt, Yes offers the User the following payment methods via Easypay - Instituição de Pagamento Lda:
- a) Credit card (Visa, Mastercard);
- b) Multibanco reference;
- c) MBWay.
- In the case of payment by credit card, the amount will be charged to the User’s card immediately after confirmation of shipment of the goods. If any ordered products are out of stock, their value will be credited back to the User’s card after the order is closed.
ARTICLE 4 – DELIVERY AND COLLECTION
- Orders shall be delivered within 10 working days after payment confirmation. Delivery is carried out by Yes or by a transport company subcontracted by Yes.
- When home delivery is requested, shipping costs will be added to the order value, depending on the destination country.
- Items not collected within three months will be returned to Yes’s stock, with no entitlement to a refund.
ARTICLE 5 – PRICES
- Prices are expressed in Euros, including all taxes and duties, taking into account the VAT rate in force on the date of payment.
- In the event of a price increase for any product, the User will be informed immediately and may choose to receive their order (by paying the difference) or to cancel it.
ARTICLE 6 – EXCHANGE, CANCELLATION AND RETURNS
- Exchanges apply only to defective items or to a different size of the same product. In other cases, the User must request a return and place a new order.
- Requests must be sent to ENCOMENDAS@YESLDA.PT within 14 days of receipt of the order. Yes shall reply with instructions for cancellation or return of the goods via the same communication channel
- The value of returned products will be available for 6 months for use in future online orders.
- Returned products must necessarily be in their original condition, i.e. in the same state, with labels and packaging as received, without any anomaly or damage.
- Socks, tights or other underwear will not be accepted for return, for hygiene reasons.
ARTICLE 7 – PRIVACY POLICY
The processing of your data is carried out in compliance with the legislation on the protection of personal data. Such data, subject to computer processing, shall be included in Yes’s database(s) and are intended for registration and the presentation of other products and services, as well as institutional information made available by Yes.
Providing this information is optional, and, under the law, you are guaranteed the right to access, rectify and delete any data relating to you, either in person or in writing, directly to the address indicated on the homepage of this website.
